Minutes of August 19, 2004 Meeting of Regular Session

In Mayor Larson's absence, Councilman Edward Herman, Jr., called the meeting to order at 7:30pm.

Roll Call:  Oller-here, Schuett-here, Brown-here, Johnson-here, Herman-here, Kirwen-here.

Correction to previous meeting minutes as follows: Brown-beer in the parks was discussed.  (A discussion then took place about what should be contained in the minutes.)
Recognition of Visitors: 
          1)  Mike Atherine, Poggemeyer Design Group-made a presentation about the Hurlbutt Ditch enclosure/re-routing and the funding associated with it.  Project is needed to route storm water away from WWTP.  The *$3.6 million project will take place in 2 phases.  The 1st phase includes enclosing and relocating the ditch. The 2nd phase involves making improvements at WWTP at the overflow basin including chlorination, screening, and new pumping facilities.  The proposed schedule for phase 1 shows EPA review and approval between November 2004-January 2005.  If approved anticipates project bidding February-April 2005.  The construction phase taking place between May 2005-September 2006. Application will be made for $100,000.00 Issue 2 grant. Also due to population and average household income, the village qualifies for a 20-year, 0% interest loan through OWDA.  Loan rate not definite until after bids are taken.  With the above proposed financing, the 1st phase will increase sewer rates approximately $4.31/mo per household.  The 2nd phase will increase sewer rates approximately $7-8/mo per household.  A proposed map of the re-routing was presented.  Obstacles include property owner easements, rock, and a high-pressured gas line along the proposed route.  Sludge options, grant writers for wood chippers, storm water separation for new construction, the efficiency of WWTP, and existing loans for sewer improvement projects were also discussed.
New Business:
          1) Ordinance 20-2004 AN ORDINANCE ADJUSTING THE 2004 APPROPRIATIONS.  The original Exhibit A listing the new appropriation totals will be changed under Sewer Operating Fund to include the $20,000.00 advance from the General Fund.  Discussion about Sewer Operating Fund, Sewer Improvement commitments, and new fund balances.  Finance Committee would like new reports on revenues, appropriations, and fund balances to date for Finance Committee meeting set for next week.  Will pass ordinance to allow clerk to continue to pay invoices in sewer operating.  Motion to waive the 3 readings and declare emergency for Ordinance 20-2004 by Schuett.  Johnson-2nd motion.  Motion to pass Ordinance 20-2004 by Kirwen.  Schuett-2nd.  No further discussion.  Unanimous roll call.                                                  
Administrator's Report:
Buckeye Sanitation has informed us that landfill costs have gone up.  It is within contract as a reason to increase contract costs.  The village has enough in the refuse fund to hold off passing the cost onto the consumer for this year.  Refuse contract comes up for bid at the end of the year.  Fishing platform construction is underway.  2002 Sewer
Improvement transfer to Sewer Operating has been approved by the auditors.  Brush pile grinding cost estimates from 2 sources.*$2,500 and $1,200.  Lower bid from a company doing work in nearby Lindsey.  Speed limit discussion with Highway Dept of

Transportation not very helpful.  Will try political sources.   Well house roofs-2 replaced.  Flashing light service disconnection was ordered.  Will remove light when disconnection is confirmed.  New fountain ordered-cost to the village should be nothing according to insurance company.  Waterfalls electricity costs around $150-200/mo.            
Clerk-Treasurer's Report:
          Audit adjustments have been made.  It was a general consensus during the exit audit to transfer money from the General Fund to the Table and General Park Funds which ended up with negative balances.  A motion is needed to that effect for the records.  Motion to transfer $2,669 to Table Fund and $356 to General Park Fund from the General Fund ($3,025.00 total) by Kirwen.  Oller-2nd.  Unanimous roll call.  Presented council with revisions to beginning balances and estimated sources for 2004.  No longer have negative balance in Sewer Operating Fund since the approval by auditors of the 2002 adjustment.  Still seeking answers to help Sewer Operating Fund.
Standing Committee Reports:
          Finance Committee-Chairman Schuett.  Meeting set for Wednesday, August 25 at 7:00pm.  Interviews for fiscal officer are going well.

          Brown-comments about minutes being sent to website, formal recreation board, information board, park benches, broken sidewalk at Quarry Village apartments, Stevenson subdivision lights, handicapped fishing platform, tipped port-a-pot at park, drainage tile, & park grant application information for 2005 (needed by September).  Suggested new playground equipment and volleyball courts being moved.  Clerk's resignation was submitted 7-15-04.

          Kirwen-question of easements being secured before school property was sold.  Easements were not secured, should be done by developer.

Minutes of August 5, 2004 Meeting of Regular Session

Mayor Lois Larson called the meeting to order at 7:30pm.

Roll Call:  Oller-absent, Schuett-here, Brown-here, Johnson-arrived late, Herman-here, Kirwen-here.  Motion to excuse Oller by Schuett.  Brown-2nd.  Unanimous roll call.

Minutes from previous meeting stand approved as written.

Appointments:  Kirwen appointed to Finance Committee due to Johnson's tardiness.

Mayor Larson announced that she accepted the resignation of Clerk-Treasurer Laura Ruggiero effective July 31, 2004.  Affective August 1, 2004 Mayor Larson has appointed Laura Ruggiero Acting Clerk-Treasurer until a new fiscal officer is hired and available to start work.

Recognition of Visitors: 
          Mark Radabaugh-wireless internet company.  Amplex provides internet service to the Toledo area and have expanded to east and south.  Focus on high-speed, wireless internet in the rural market to both residential and business.  Most towers are with Lucky Farmers silos.  Have approached villages to mount on water towers.  Currently have sites at Pemberville, Woodville, and Elmore on water towers.  Service customers in town and surrounding area.  (Provided examples of equipment and antennas.)  The equipment operates at 2.4 ght and 5.7 ght.  Realizes there is a concern of radio and paging systems on tower that might have interference.  Will have to research to see what frequencies those are on.  Don't think will interfere.  Generally those systems are much lower in frequency.  In exchange for use of the water tower, will provide the village with radial and service at no cost to a designated village office.  Generally police and village office combined.  Can provide service to multiple locations, but will give only one radial.  Extra radials will cost $500 each.  Mayor-don't we have items on water tower already.  Benton-Hamm station, 2 repeater units, and another antenna.  Don't know the frequencies.  Would like to get the information on your equipment to our engineer to give us a read on whether it would effect our equipment.

Old Business:
          Mayor-who's paying the electricity on these softball all-nighters?  Gerwin-they said they would pay for the electric.  Mayor-what about clean-up?  Gerwin-I haven't heard anything from our guys about cleaning up.  I'm thinking Bob may have.  I really didn't think to ask if there was a problem afterward.  Kirwen-who is running it?  Gerwin-Keith Krotzer.  He had come to council and asked permission.  Kirwen-has he come forward yet to pay?  Gerwin-we just have to issue him a bill.  Ruggiero-how is that figured?  Gerwin-just give him the bill.  There hasn't been anything other than that on the night-lighting bill last month.  Mayor-something should be given to them in writing that they're responsible for cleaning the park after the tournament.  Gerwin-OK.  Kirwen-any police reports during the last one?  Benton-a couple of parking complaints.
          3rd reading of Ordinance 17-2004 AN ORDINANCE ENACTING DESIGN REVIEW REGULATIONS FOR THE VILLAGE OF GIBSONBURG, SANDUSKY COUNTY, OHIO.  Ruggiero-was Exhibit A approved?  Gerwin-I gave a copy to Ladd to review.  Motion to pass by

Herman.  Schuett-2nd.  Brown-I would like to know the revision.  Beck-Greg had a description of the central business district and we removed the solely residential addresses.  Brown-did we make sure it was accurate?  Linda Hall said we could put in there that it eliminated all residents.  You don't have to put in exact house numbers.  Beck-that may not be a bad thing to add at the end.  Mayor-any further discussion?  None.  Unanimous roll call.

Mayor's Report:                                                                                          
          Gerwin will attend a meeting on Friday, in my place, for Pardoning for the Future in Fremont.
Administrator's Report:
Water and sewer lines are almost completed to the industrial park.  Getting an estimate to extend the water line to get a fire hydrant for fire protection.  Flashing lights at Yeasting and S. Harrison, with school no longer being there, I would suggest we remove those.  Leave the 4-way stop, but remove the flashing light.  W Madison sewer was just videoed.  They could get too far because as it goes under the railroad tracks that whole section is partially crushed.  The rest does not look much better.  That is a project we should look into doing as part of this downtown development.  For our share, we should have money set aside for that.  The tile is not crushed to the point where it isn't functional, but it will need to be replaced.  It starts in front of the elevator, goes under the tracks, and comes to the Main St intersection.  From Main on east that will be replaced with Issue 2 money we're receiving.  Schuett-is that on the sidewalk or the street.  Gerwin-the south side of the street.  Not under the sidewalk.  Tom Tille is pulling together some things for the fishing platform.  Insurance company was called today for an update about the fountain, haven't heard back.  Street lighting I will talk about at the end of the meeting.

Clerk-Treasurer's Report:
          1) The books are now current.  UAN is currently in August 2004.  Up-to-date!
          2) Will make the audit adjustments on Tuesday when visiting clerk can be here to assist.  Will close bench and path accounts at that point.  Brown-you may want to wait on that.  Bob Veh may want to pave the path now.  I'll know more soon.  Ruggiero-do they want the path paved, given maintenance, etc?  Mayor-he's going to pave the path around the quarry?  He's going to pay for the whole thing?  Brown-he's considering it.  Mayor-whose going to keep it up?  Brown-just like anything else.whose going to keep up the veteran's memorial?  Mayor-this year is going to be a tight year with funds.  I don't know that is something we should be spending money on.  Brown-you wouldn't be spending it.  It'll be all donated.  It'll take 7 years before you'd have to maintain it again.  And you could possibly go for a park grant.  Mayor-what about cleaning it?  Brown-do you clean your streets?  You pave your streets with tar and do nothing to them.  Mayor-we sweep and plow them.  Brown-but it doesn't take maintenance to keep it up until 7 years later.  Mayor-you mean we don't touch it for 7 years?  Brown-no, you don't have to do anything to it.  After 7 years, you could go for a park grant or possibly Bob Veh could come back and donate the rest of the money to maintain it.  He is very concerned that things are not being maintained.  Mayor-I'll talk to Robert Veh.  To close out the bench account, can I just transfer the funds back to general fund?  Was there an ordinance or motion to do so?  Schuett-I don't believe there was ever a motion.  Brown/Gerwin-just buy whatever is needed to zero that account out.  Gerwin-hold

off on closing it out as we may have some concrete costs associated with setting those last few benches. 
3) Sewer operating fund-we had talked at the finance committee meeting about adjusting utility receipts to put more into operating.  But after having spoken with Greg, I realize we cannot do that because the loans for the WWTP improvement are contingent upon that revenue going into the sewer improvement fund.  Also, Greg brought to my attention that the septic tank replacement fund can't be messed with.  The cost to replace the smaller tanks may only be around $1,300-1,400, but the larger tanks could cost around $5,000.  Gerwin-I think we need to let that go.  We need to look beyond today and a bit further down the road.  I think we replaced a little over a third of the tanks when the system went in.  Based on some of our experiences, some of those aren't even lasting 20 years.  We're having lids collapse.  The nursing home tank is a big one and will cost a lot to replace.  We need money in there for that.  Ruggiero-so what was suggested about re-arranging the rate structure.I don't think that will work to help the operating fund.  After having spoken to Peg, it appears that this account has been in trouble most of last year.  Johnson-that's why we had the rate increase.  Ruggiero-its still showing signs of trouble.  Kirwen-is the money from the rate increase going to that fund?  Gerwin-yes.  Kirwen-why is it not generating more money than last year?  Ruggiero-is it not generating more money or is sewer operating just expending more?  Johnson-that's where we have to go back and look.  Ruggiero-it was suggested to me by Finance Committee when I first started that some of the employees be moved around to different funds.you wanted some of Greg's salary in the water and the sewer operating.  Where before he was just in general fund.  I have him 4 months general, 4 months water, and he hasn't even been put in sewer yet.  That will happen the last 4 months of the year.  Kevin will appear in the sewer operating at the end of the year.  Peggy, was she always paid out of water and sewer?  Gerwin-yes.  Ruggiero-she was in sewer the first 6 months of this year, so she's out of it the last 6 months.  So I don't know if those changes that were suggested to me are what's sinking it.  Johnson-we still brought in more than what was spent out.  Ruggiero-I still have to make that $27,000 audit transfer.  Gerwin-you look at what you don't have encumbered.  Johnson-when we're running a tight ship like we are now, you can't encumber a whole year's stuff up front..Ruggiero-I haven't done that.  I'm actually to a point that I can no longer move money around within that fund to pay for operating supplies.  You had all suggested that mosquito spraying come out of sewer operating.  I cannot take it out of there.  I cannot justify creating more expense in that account, because its in trouble.  Mayor-I don't think it should come out of there.  Gerwin-its environmental.  Ruggiero-I've got that expense in parkstree lawns being considered parksbut its coming out of general.  Gerwin-mosquito donuts are in the catch basins.  Ruggiero-those I put in sewer operating.  Schuett-the loan partdo we have paperwork on that?  How much is the loan and how much is being brought in for that.  Gerwin-we can have Poggemeyer come in to tell us.  Ruggiero-roughly $120,000 year to sewer improvement.  Gerwin-when we looked at what we're paying out in the loans, it eats up a pretty good chunk of that.  We could get you a report for the next council meeting. What I would do, those 2 transfers from 2002 that I suggested, I would make those.  They are truly capital items, not operating.  Johnson-has the auditor blessed them?  I wouldn't do them until you speak with the auditor.  Gerwin-I have no problem with that, but I'm sure they'll go along with it because it's something they didn't catch.  Kirwen-we should have the auditor look at it.  Mayor-you're going to have to pay for every little bit we have the auditor do.  I don't know

why we can't just do it.  Johnson-because they'll write us up at the end of the year.  Mayor-not this year.  Ruggiero-I'm the who signed saying I'd make these adjustments and you all are dabbling with numbers, but giving me no where to go.  Gerwin-also the amount we're building up in sewer improvement fund shouldn't be touched because in the next year or 2 you'll need money when we go for grants for the downtown.  We'll need matching dollars and that sewer line that's partially crushed needs replaced.  You'll have the funds there for that.  Kirwen-then I suggest that, if that's the case, we should have a rate increase again.  If the operation of the sewer is not making enough money to operate, you have to have a rate increase.  There's no other way around it.  We need to get that accomplished as soon as possible, because we have no other way to go.  Does everyone agree with that?  Mayor-it depends on how much of an increase.  Brown-why are we spending so much on the operating?  Is there a place to cut back?  Gerwin-you're going to be spending more because we increased the capacity for storage and we added a lot of electric equipment that we have to run to do that process.  Brown-and that was to take in more sludge so why are we pursuing making money off the sludge.  Gerwin-the problem with that is that EPA says they will require us to test everything that comes through, which is very expensive and cumbersome.  That's why we dropped getting the approval to bring in sludge from outside the village.  Mayor-how much do we pay now for sewer?  Gerwin-don't have that info right now.  We can have Poggemeyer look at our loans and see what has to be dedicated to that and see what's left over.  Johnson-you're assuming that we can't reduce sewer improvement, but I don't know that we're not over recovering in that area.  Isn't that where the loans are out of?  Ruggiero-We just starting paying on those loans in July.  Gerwin-we also have to take some out for our share of the Issue 2 E. Madison Street project.  And we have to do something on S Main where we identified a problem down there.  We have a number of projects.  Mayor-get with Poggemeyer to find out and if we have to we'll increase the sewer rate.  Ruggiero-another thing that hasn't been figured into Sewer Improvement is the Hurlbutt ditch re-routing.  Gerwin-1.8 million.  Ruggiero-which will be complete in a 24 month period.  That does not have any revenues coming in for it.  Gerwin-we need to look at that too.  Dick Heyman will be coming in for the next meeting.  I'll have him look at both of these issues. 
          4) Income Tax Information-I made a spreadsheet on what was brought in for 2003 compared to 2004.  We're behind from last year.  We had been ahead, but now we've dropped.  Johnson-when that's happened before, it was a matter of a deposit going in later.  Ruggiero-I asked her for trends, when she knew most of it comes in.  She said it is paid in quarterly, but the last quarter does not generate as much.  I only have 2 years worth of data.  I obtained last year's information from Becky to make this comparison.  Otermat-remember that last year would be higher due to the construction workers at the school.  Ruggiero-I've taken that into account even when projecting revenues at the beginning of the year.  Through the beginning of the year, it didn't show a drop in revenue, but now it does.  And I don't know if these new homes being built have owners with incomes that we weren't seeing before.  I don't know.  Becky doesn't seem to know of any trends.  I have no idea of where we'll fall at the end of the year.  I was very conservative, knowing the construction workers were in town last year.  Mayor-I questioned her 2-3 times concerning this.  The only thing she told me that like Mosser could not pick out of their payroll who worked here.  Ruggiero-I am sent Mosser time records and had asked Becky if she took in that information.  She said she doesn't get those.  Whether or not that's something she can figure that information from, I do not know.   Schuett-Becky was invited to this meeting and I expected her here.

Ruggiero-she called me to say she couldn't make it, as her father was having some health issues that she was helping with.
          5) Time Warner income-Everyone has been interested in those franchise fees.  Ladd brought me in a check the other day, but this is a whole different ballgame.  It's a pro-rated real estate tax check for .Ladd you can probably explain it better. Beck-what happened was that when Time Warner had possession of the tower.taxes are a year behind.so for a portion of 2003 they had possession of the tower and they are paying us for their portion of the real estate taxes for that time.  Basically what will happen is that Time Warner paid for the 1st half and pursuant to our agreement with the county, they will pay the 2nd half.  All we do is that we have a check for their money, and when the bill comes its ours to pay.  Ruggiero-is there anymore to that?  Are they just paying a portion of that 1st half is that the full amount?  Beck-that I do not know.  Ruggiero-it didn't say in the contract?  Beck-they didn't even send that check to us.  Ruggiero-yeah, somehow this check was dated March and ended up with the County Commissioners.  Beck-and it stayed there until last week.  Ruggiero-the address on that particular check is the tower address.  So we don't know if they are getting the mail for the tower..not that I knew the tower got mail.  In the meantime, I called the 800 number listed on the check.  Greg and I have tried different numbers for Time Warner and haven't been able to get through.  So I called the number on the check and asked about the franchise fees.  There was a check issued to us in February that hasn't been cashed.  This check's address is 120 N Main.  I put a stop payment on that check and they are reissuing the check.  It should be here next week.  So that's $10,000 for the Economic Development fund.
          6) Codified Ordinances-does each councilmen have an ordinance book at home?  Are they updated?  I'm finding odds and ends back here that have never been given out.  Brown-mines updated.  Benton-how often?  Brown-whenever they've been given out.  Benton-but how often.  Some of ours are behind because Jo didn't feel like giving them to us.  Be careful using those books.  Make sure they are updated or you could be operating with erroneous information, which could cause us problems.  Gerwin-copies are there if anyone wants one.  Benton-but these are only things that have occurred in the last year.  If you haven't received each update for the past 20 years.  Ruggiero-I found copies of a traffic code that was sent in January that I knew nothing about.  I've been told that normally we receive one full complete set from the company and that wasn't sent this time.  I don't know if any of these are fully updated.  Gerwin-mine is.  Benton-I don't understand why we're receiving a separate set for the traffic code when the traffic code is usually updated with the regular ordinance update.  Ruggiero-I don't understand that either.  Benton-the village is throwing away a lot of dollars.  Ruggiero-someone should look at that.  Benton-we get too many of these.  I don't understand why each of council should have these.  None of you enforce these.  If there's a book here that you can research, why do we need 40 books.  Ruggiero-do you agree that council does not need those?  Its very expensive.  Johnson-I would say it would be better to have an assured up-to-date copy here that we could come in and use anytime.  Ruggiero-and as councilmen come and go, are those passed on to the new councilmen?  And can you guarantee the guy before you updated them?  Gerwin-Mike and I will get together and get that squared away.  Benton-we have to get a certain amount of thesefor the courts, the library.  Johnson-do they have an online or CD version.  Ruggiero/Benton-they just sent information saying that a CD will become available.  Ruggiero-currently we're getting about 15 copies and that's cut back from last year.

          7)  BAZ update-BAZ has currently disconnected the 2 internet lines.  One wasn't being used, it was to a dead line.  Another was to my computer.  Beings I don't use the internet much, I thought it was ridiculous to pay $43/mo.  What we did was hook my internet connection to the fax line so we're not being charged for 2 lines each month.  The sewer line is no longer connected to the clerk's office.  On Mike's suggestion, I called and had the extra police line disconnected.

          Brown-web page-would like copy of minutes on a floppy disk.  Ruggiero-I don't do them at the office, I type them at home.  I could put on floppy.  Unsure of how new person will do them.  Village brush pile-is there a way that Hovis could chip it up.  Gerwin-I had him in and he is not interested.  Perhaps we could have people run it through as they brought it in at certain times.  Will not wade into the pile and pull it apart.  Brown-once pile is gone, we could say twice a month or so it's set up where people could bring stuff out?  Gerwin-only problem is where we get the funds to pay for it.  Brown-can't burn it, so we'll have to come up with something.  Johnson-could we bid it out and add a surcharge to you refuse bill.  Mayor-you'll be charging everyone the surcharge when the whole community does not use it.  Ruggiero-you've got a lot of older people on fixed budgets.  You're increasing sewer fees again and now the refuse fees will be up.  Kirwen-don't you think they'll be mad if they can't use the sewer, etc.  Ruggiero-yes, but not everyone can afford these continuous increases.  Johnson-let's shut the brush pile down and see how many people..Gerwin-we could just say no one's allowed to bring brush.  Brown-a lot of towns do nice things for people.  This is a service that you provide them because they have trees and they're trying to keep their yards up.  If you don't have this service, you'll have a messed up village because people can't get rid of their stuff.  Ruggiero-the budget needs to be trimmed somewhere.  Mayor-what about a controlled burn?  Ruggiero-fire department drill?  Bauer-some laws control that, but some of the things that can be burned is natural woodbranches.  I don't know the issue, no one has consulted with me, or who's causing the issue.  Benton-there is a certain distance you need to be from dwellings for an agricultural fire.  Gerwin-when the house went in, that may have thrown things.  I'll work with Ed, maybe we can get this worked out.  Bauer-who's saying we can't do it?  Gerwin-EPA sited us.  Bauer-can I see a copy of the citation.   Gerwin-yes.

Park meeting was Tueday-we saved a turtle.  Tom Samson and Becky Renner have never attended.  The Wittes haven't attended the past 3 meetings.  We met with Tom Tille about the fishing platform.  We discussed formalizing into a formal recreation board that way we could pull in people from the schools.  Beck-you'd have to form a joint recreation district with other governmental entities and that would become a separate governmental entity.  They could go for tax levies, etc.  Brown-the park board now doesn't have money to operate, we don't know what we can pursue, we don't know where we're going, we're fighting with the baseball associations.  I think it'd be nice to pull together as a group.  Mayor-with money as it is, this is not a good year.  Brown-it has nothing to do with the money.  My son, who just graduated from college, is volunteering his time to officially form this recreation board.  It's going to take 6 months or so.  Mayor-let him put some stuff together and he can present it to council.  Brown-we need the backing from council.  He's going to get a job similar to this, not that I'm asking to pay for him for this.  But I don't want him wasting his time to develop this plan if no one supports him.  Mayor-let us think about it and we'll give you an answer next time.  Waterfalls are not on-Gerwin-I'll get to that.  Mayor-does it need to be on.  How much money is that costing?  Johnson-we've got money there.  Brown-we're building a nice handy-capped fishing platform over there.  You can enjoy the falls while fishing.  That was the whole plan.  Mayor-how much is that costing.  Gerwin-with the fountain and falls it was running $500-600/mo.  Unsure of the cost of just the falls.  Brown-(mentioning liter at the parks)  Benches that need to be concreted in could be put on fishing platform.

Fire Chief Bauer-New fire truck needed.  Last August we formed a committee at the fire department.  Started researching specifications to replace G-1 truck.old ambulance.  Its used to haul manpower.  Given the size of the station, we don't have room for a bigger truck.  We found a truck that's being built called a rescue pumper.  Our current 24-year old G-5 truck should be replaced sometime soon.  We decided that to save maintenance money and space, if we pursued a rescue pumper, we could eliminate G-1 and G-2 (the truck in Schuett's building) and rearrange the equipment in the existing station providing we get the new truck in the dimensions to fit the station.  It can't be too high because of the 10 foot tall doors and can't be too long because there's only 30 foot inside the station.  We met with Ed Herman and John Fork from the township to run by them the plan.  The township contacted the auditor to see what type of levy is needed to buy this truck.  Ballpark figure to buy the truck is $350,000.00.  Township clerk spoke with the auditor got information.  The township passed at Monday's meeting to get information from the auditor certified.  It appears it will take 8/10ths of a mill for 10 years to provide $350,000 plus pay the interest on the loan.  Once they get the certification, they plan on having a special meeting to go to the next step to put on the November ballot.  Last levy just expired last year, was for 9/10ths of a mill and wasn't close to $350,000.00.  Things that have changed are lower interest rates and with more houses being built we have a better tax base.  Nothing that the village needs to do but would like council and mayor's support.  Will not cost money from village budget.  If we are

successful at this, we'll be eliminating 2 older trucks.  Mayor-can we get a grant for this?  Bauer-yes, we've applied for grants.  The second item I wanted to discuss tonight was we received, from Homeland Security from the county, $4,500 to pay for half of our rescue air bags.  The grant we got from the state department of EMS, we were awarded $4,000 for EMS equipment and training.  Yesterday I received a call from Paul Gilmore's office saying that tomorrow we'll be notified that we'll be receiving a Homeland Security FEMA grant.  We applied for $89,055.  In that grant we, Madison Twp and the Village of Gibsonburg, are liable for 10% of that.  Not sure of all details.  But think township and village will each pay 5% of it.  Turnout gear cost $1,370 per pants and coat.  An e-mail I received said they would only pay up to $1,200.  We requested 35 sets in the grant.  With 50 members, 15 sets being current.  They wanted to know if we'd still accept the grant knowing they wouldn't pay the entire cost of each set.  Once we see the final numbers, the fire department may contribute toward some of this.  We have some money that we like to put toward equipment for the new truck.  I think the federal government share of this is $76,275.  This amount cannot be used for a fire truck, though.  Items we applied for are 35 sets of new turnout gear, 6 new air packs with spare bottles, new radios for the fire trucks.  Would like something from council saying you support this.  Motion to support fire department levy by Johnson.  Kirwen-2nd.  Unanimous roll call.  Mayor-I'll write up a letter also.

Minutes of July 15, 2004 Meeting of Regular Session

In Mayor Larson's absence, Edward Herman, Jr called the meeting to order at 7:30pm.

Roll Call:  Oller-absent, Schuett-here, Brown-here, Johnson-here, Herman-here, Kirwen-here.  Motion to excuse Oller by Schuett.  Kirwen-2nd.  Unanimous roll call.

Minutes from previous meeting had the following corrections:  Beck-page 2 had a statement by Beck, but I wasn't present.  Johnson-my wife, Debbie, is referred to as Deborah and its just Debbie.

Old Business:
          2nd reading of Ordinance 17-2004 AN ORDINANCE ENACTING DESIGN REVIEW REGULATIONS FOR THE VILLAGE OF GIBSONBURG, SANDUSKY COUNTY, OHIO.  Exhibit A discussion:  Ruggiero-is there a better Exhibit A than what was produced from the fire code?  Gerwin-that is basically what they filed under.  Beck-we need to come up with a better Exhibit A.  Gerwin-I know that the activity that takes place can be in areas within that designation.  Beck-we need to do it in detail so we can take out anything that isn't a business.  If not, we're going to have design specifications for a couple of houses.  We do not want that.  Gerwin-would we be better off to add in there that this does not apply to any residential buildings within the parameters.  What we have done is taken the central business district and in the future those residents have the potential to become downtown central businesses.  Beck-I would exclude them.  If they do switch usage you could add that area.  I would go through and say this is the area less whatever the address is.  Gerwin-OK, so we can do it by address.  I'll have it for the next meeting.  Brown-I'm just guessing that it is all correct.  Its quite an ordinance.  Gerwin-that's the ordinance that we were given as the sample ordinance.  Beck-actually we were given 2-3 examples and that's me taking those 2 or 3 and combining parts.  You're right that is not going to be a controversy free ordinance because you're establishing a design review committee that's going to tell those included individuals what they can and cannot do as far as any refurbishing of their property.  That's why we want to exclude those houses.  Johnson-do they understand that?  Do they know we're doing this ordinance?  I was at their meeting tonight.  Schuett-is there a way to designate only commercial property and not residential property?  Beck-I don't think that's possible here in town because some properties are both.  Gerwin-I'll get the addresses of strictly houses.  Brown-seems like a lot to try to enforce.  Schuett-I was just thinking about in the future.  Let's say a business knocked this building down and they want to put a house up there.  Now this address is on there and they can tell this house how to do things.  Gerwin-the design review board has authority over whether they can even tear a building down.  Herman-should we have Linda Hall come to the next meeting before the final reading?  Gerwin-we'll send a copy of what we have back to Linda and send copies to the committee.  Beck-I don't think we can go forward with the program without the ordinance.  Kirwen-we'll just do what Ladd suggested.

Administrator's Report:
Fountain could not be found during the dive.  Mike wrote up a report.  We filed with the insurance company.  I sent a copy of the report, a copy of what it cost, and copy of the present cost to replace.  Johnson-what is the cost to replace?  Gerwin-$7,200.  Johnson-what's our deductible?  Gerwin-$1,000.  The other thing I do not know for sure is if they'll depreciate it.  That's all I have for now as I spent a lot of time putting together next year's budget.          

Mayor's Report
          Herman-I have a memo from Mayor Larson stating "as you are aware, Clerk-Treasurer Laura Ruggiero, has submitted a letter of resignation effective July 31, 2004.  I am in the process of seeking a resolution to this unfortunate situation and will be calling a work session prior to the next regular scheduled meeting of council to work toward a resolution to the problem."  Brown-where do we go from here.  Are we just waiting for Lois to call a meeting?  Gerwin-yes.  Ruggiero-I'm flexible on the date.  I'm not planning on just leaving.  I'll help train the next person. 

Clerk-Treasurer's Report:
          I ran across an ordinance on the downtown planning stating that it is to come out of the Economic Development Fund.  I had it set up in the General Fund.  The Economic Development Fund doesn't have money to cover our share ($7,500) of the commitment.  Once Widmer's land sale check is deposited, there is a little cushion there, but there are some other expenses to come from that fund.  There may need to be some money transferred into the Economic Development Fund to fulfill those obligations.  Johnson-why is that out of Economic Development?  Ruggiero-looking for something else I found this ordinance.  Here is a copy.  Schuett-at that point in time we can get together and have a Finance Committee meeting and decide that.  Johnson/Gerwin-it'll have to come out of General Fund.  Ruggiero-if there is any in there for that.  Ruggiero-it may just be $1,000 or $2,000. 
          Sewer Operating Fund, as stands at the end of May, with the $20,000 advance (I've made a copy for everyone and highlighted the material I'm going to discuss).  The end of May's Sewer Operating balance is $30,000.  If we're to take that $27,000 audit adjustment, that'll leave it with $3,500 to spend for June.  If you notice the expenditures for the month of May, they were $16,000.  So this fund is not out of trouble yet.  Johnson-I'd let it ride another month.  Ruggiero-I'm into June's books.  The audit adjustments were dated June 1.  Johnson-so this $27,000 comes out of Sewer Operating and goes to where?  Ruggiero-Sewer Improvement.  That's the illegal transfer that was made last year.  So I'll be in negative numbers again in June.  Schuett-so let's set up a Finance Committee meeting.  Gerwin-when you tweaked the rate last time, do you increase the sewer operating?  Johnson-yes we did.  We need to look at how we're splitting the whole thing.  Obviously, based on new information, we should be putting more into sewer operating.  Gerwin-I tried to do some trending on sewer and water operating.  I think we're going to run about $30,000 a piece in

the red.  Now in sewer operating, we've got 2 things upcoming that we haven't had in the past:  1.  Our electric bills will be going up because we went from a 90 kw generator to a 250 kw generator.  That means we have a lot more load there.  I'm guessing the electric for the sewer plant is going to go up between $7,000-10,000.  We also now have the capacity to store sludge and we need to be going out on a regular basis to pump septic tanks.  This means 250 tanks/year.  The piece of equipment we have is not able to do that kind of work, which means we'll have to contract it out.  That doesn't mean we still won't be going out to pump septic tanks.  But until we get through that 4-year cycle, and I'm projecting we'll spend between $18,000-23,000/year just pumping septic tanks (which we've never done on a regular basis but EPA requires that we do.  They've never asked to see our reports, but I think its because they knew we hadn't a place to store the stuff.)  Johnson-I understand, but you're talking futureGerwin-we should start now, I don't want you to be caught short. The electric bill is going to go up regardless.  The other piece is something we can't wait much more than next year to start and that's $18,000-23,000 additional in the sewer operating account.  Schuett-in the meantime, why don't you look at a lease.  Gerwin-you mean leasing a special piece of equipment.  The other problem is we need a heated place to put it.  Johnson-we should bid it out.  Gerwin-yes, we'll get quotes.  I want you to be aware of these things that are upcoming.
          May 2004 is closed out.  The books are now caught up to June. 

Standing Committee Reports:
          Finance Committee-Chairman Schuett.  Finance Committee meeting set for Wednesday, July 21, 2004 at 7:00pm.  Since we just finished our budget hearing, we need a motion to pass the budget.  Motion by Schuett.  Kirwen-2nd.  Unanimous roll call.

Individual Council Member Reports:
          Schuett-there's been a party interested in putting a repeater for internet service on our water tower.  In exchange for that (they've done some other villages and have provided us with contracts with the other villages) would provide the village offices with free high-speed internet.  So I wanted to present that to council.  Johnson-some company is going to make a proposal.  Schuett-Sue Cook from Woodville e-mailed it to me.  They have other communities in the area on contract and are very interested in moving into this area.  Benton-I would suggest having our engineer look at it because we have a multiple repeater station mounted on there and want to make sure there's no interference.  Gerwin-this is to offer wireless internet to the local community for a fee?  Schuett-yes, I believe that's correct.
          Brown-How's Lois doing?  Gerwin-she's out more, looking better, and sounding stronger.  Dave, did you attend the park meeting?  Johnson-yes, I did.  They discussed fundraisers for the parks.  There are planned activities this fall that maybe a fundraiser could go along with it.  Herman-Sept 12 is a planned parade and service for the veterans.  Johnson-paddlewheel boats, etc.  Brown-I was told you can't charge for anything down there or you could be held liable.the paddleboats would have to be free.  Johnson-we could tag it on the GCC's 5013E (?) and do it as a fundraiser.  Waterfalls-haven't had a chance to check into it.  Perhaps Eddie and I can check it out.  When we discovered the fountain was gone, we tried to reset the falls and they wouldn't reset.  I haven't gone beyond that.  Johnson-those pumps

aren't gone?  Gerwin-just the fountain.  Path Account-is that closed out?  Ruggiero-haven't had a chance to do it.  Brown-we have to spend it.  Herman-right.  I thought you were going to use the $100 left to close off the path, put a chain up around the memorial, whatever you want to do.  Herman-we can't do that, can we?  Ruggiero-it seems that account disappeared off the books last year and reappeared with these audit adjustments.  Does that need a motion to move that money?  Johnson-don't move it, just spend it on the path.  Herman-back to what was discussed earlier about the September activity.  Who's heading that up?  Johnson-the park committee.  Herman-we're having a meeting shortly.  Johnson-is there a head of the park committee?  Brown-they never have.  I always wanted it to be like the tree committee.  There haven't been enough interested and I'm just a liason.  Park Bench Account-is that closed yet?  Ruggiero-in June or July there are some expenses that haven't been put in the computer.  It can be closed after that.  Gerwin-we were going to put the new benches around the quarry, but with the rock being so close to the surface, it might not work.  Information Board?  Gerwin-that was staked but never done.  OK.  Handi-capped Fishing Platform-trying to get a commitment from Tom.  Brown-we need to get that information together to get reimbursed.  If Tom can't, we need to find someone else.  Ruggiero-who's reimbursing us.  Gerwin-no one, the money is already there.  Herman-we have to have the construction started.  Guardrail-park committee suggested.  Ruggiero-no money at this time.  Sent letter to Bob Veh with gazebo information giving him options.  His wife mentioned maybe spending the gazebo money on the path.  Bob doesn't want it spent on the path.  The auditor's have said money cannot be spent on path unless we go to court.  I told him that he has to make a decision because if not the money has to go back to him in 5 years.  Hopefully I hear back from him soon.  Burning situation-what's going on?  Gerwin-right now nothing.  I'll see if we can get someone in to chip it up.  Auditor's suggestions on policies?  Gerwin-I'm working on them currently.  Stevenson subdivision lights?  Gerwin-I put a hold on them.  All of that comes out of General Fund.  I'm afraid to spend any money until we get a better feel of where we're at.  Johnson-so we pay for that?  Gerwin-all of the street lighting is out of the general fund.  Johnson-you mean the electricity.  Gerwin-no, the street lighting is out of the General Fund.  $18,000 a year.  That's everything.  Poles, wire, maintenance, energy, everything.  Johnson-so the developer isn't responsible for putting in the street lights when they put in a development.  Gerwin-we'd have to make that a responsibility of them.  Brown-you've been saying that for a year now.  Ruggiero-is that part of the subdivision regulations?  Gerwin-yes.  Kirwen-I don't understand this.  I thought Stevenson was paying for the lights.  I thought that from the beginning through all of this.  Now you're saying the town is paying for these lights.  Gerwin-no, I said that because they are underground, we will charge them the premium for the underground over the overhead costs.  That will be accessed on their real estate taxes.  Kirwen-then we need to changeThere better not be anymore subdivisions put in this town until that is changed.  Gerwin-we don't have to wait for subdivision regulations to pass an ordinance that says this is the way its going to be done.  Kirwen-we should have passed it when we were talking about it before this.  The way I took it was that the developer was paying for the street lights.  Gerwin-we've never had underground lighting put in prior to this.  It's always been overhead and the village paid up the full amount of any street lighting that's been put in.  It always has.  Schuett-I thought the lighting was in the zoning.  Gerwin-no.  Johnson-you told me we can't do the new subdivision until the zoning is done.  When is the zoning done?  Gerwin-I'm trying to keep that moving.  I've got to bring in Char.  They want some better explanations on compatible

zoning between areas as far as the zoning map is.  I'm trying to set that up in the next week.  I can't tell the committee what to do.  That's the committee's decision.  If there's another way you want to do the street lighting, you tell me and I'll get with Ladd and we'll write an ordinance and resolve it right now.  Brown-we've been asking about this since Aug 7 of last year.  Herman-so we're responsible for Busdecker's subdivision new section lighting?  Gerwin-there has never been any policy on underground.  All I did was take the policy used in other cities.  I used to do street lighting for Toledo Edison.  The city of Toledo, Oregon, a lot of those communitieswhat they do is get the price of overhead installation, compare it against an underground installation (we've talked about this I don't know how many times) and the premium for the underground is accessed on a per foot basis to the property owners.  It goes on their property tax.  The village pays the rest.  Now if you want to change that, you can change it.  You can access everyone on their property tax for street lighting if you want to.  Kirwen-the thing is that you failed to mention in the past that the city was paying for the lights.  Gerwin-its been in the budget for 50 years.  Every year we look at it.  Johnson-that's the electric to run the lights.  Gerwin-no.  It doesn't work that way.  I've told you a dozen times.  The whole investment is part of the price of the lighting.  I wouldn't tell you any different.  I'm the one who designed the rates for them.  I'm the one that sold them to the communities.  It's a part of the rate, the taxes, the investment in the installation, the maintenance, the replacement.  All of that is part of the rate.  That is billed to you, so much a month, per unit.  It's in your general fund budget.  Its been there.  $18,500 to $20,000.  Johnson-so you don't pay it all at once.  Gerwin-you pay it on a monthly basis per light.  And its in the rate.  That's why I'm fighting Edison over these steel poles.  We have paid morethere is negative salvage value on those units.more than enough to cover the removal costs.  You can't justify charging someone to remove something that you've already collected for.  That's one issue I'm fighting Edison through the Commission and through the state legislature.  It's all based on the same thing.  I can walk you through all the components that go into that rate calculation.  I did it for 5 years.  Herman-what kind of lighting can go into Busdecker's?  Gerwin-Busdecker is going to have to secure easements like Gary did, because Edison will not put them in without easements.  Once those are put in, if we do it the way we are talking.Herman-underground?  Gerwin-I'm sure he's not going to want overhead.  Herman-there's no wire underground now, everyone's driveways will have to be tore up?  Gerwin-more than likely they will come down from the back between property lines to put the light and pole.  The easement will have to be secured by Busdecker, given to Toledo Edison.  We've talked about thiswe can't do it because its government spending money for profit business.  We can't legally do what they asked us to do.  That's why this thing drug out.  Gary Stevenson secured his easements.  Busdecker has to do the same thing.  Gerwin-once that is done it's a matter of how we're going to pay for it.  Johnson-how much per pole?  Gerwin-I can get you price per light.  Underground, overhead, price it up and the difference, unless you want to change it, we pay for the overhead, they pay for the underground.  Johnson-that's fine.  Tell us how much it is.  I just thought what we were paying was the electricity.  Herman-I wasn't aware of it either.  Gerwin-it included electricity, depreciation on equipment, an accident and have to replace a pole, they supposedly change the bulbs every 4 years.Johnson-we don't buy it upfront.  Gerwin-no, it doesn't mean we can't.  I don't know how they handle that anymore.  It used to be that if you want to pay the underground investment, then they'd give you an energy and maintenance only.  That was very reasonable, but I don't think they do that anymore.  The question is do

you want to absorb that additional cost, because that comes out of general fund.  Johnson-how much and how many poles at each place?  Herman-we pay $18,000/year and they pay for the poles?  Gerwin-our street lighting, we have about 400 streetlights in town.  The sum of all of that is around $18,000/year.  I'll guess it'll be around $70-$80 overhead fixture installation per year.  Herman-why is it being held up for that little amount of money.  Gerwin-because of the underground.  Edison got rid of the guy who wrote the easements for streetlighting and they are forcing that on everyone else.  Johnson-I'm assuming Busdecker knew from the start that he needed to get easements for streetlighting.  Gerwin-I will talk to him.  Herman-why does he need easements when he owned the property to begin with?  Gerwin-the game changed between the time they developed Phase I (Gary and Busdecker).  Up to that point, Edison was doing easements, and all we said was that we want you to install the streetlights and then they'd bill us once they were in.  They changed the policy and didn't tell anybody.  When we went to get streetlights, they said you have to get easements.  Beck-Stevenson is building easements into Phase II?  Gerwin-yes and he's secured easements for Phase I.  Beck-is he picking up the difference in costs?  Gerwin-when I explained how it was done and that it'd be so much per front foot that would be put on real estate taxes, that was fine by him.  Do we want each of those people know that's what's going to happen before it happens?  Johnson-what are you talking about.  Gerwin-12 lots down there that have street lighting as a new accessment on their taxes.  We'll give them a courtesy notice.  Brown-I still don't think its their responsibility to pay for them.  It should be the subdivision.  They agreed to put in the street lights.  Beck-new subdivision regulations will require.Gerwin-what we should do is not wait for that.  Ladd, you and I should get together, put together an ordinance that spells out how any new streetlighting will be in new subdivisions.  Johnson-it needs to handle streets, lighting, trees, sidewalks.  Kirwen-it has to be a whole package.  I don't want this messing around.  New subdivisions will be coming inbig.smallwe need something where we don't run into these problems.  Another problem will pop up and it'll cost the village money when it really shouldn't.  Gerwin-I don't disagree with you.  Johnson-do you have examples of subdivision ordinance.  Gerwin-yeah, but its made for cities.   There subdivision proposals take 18 months to 2 years and that's not workable for us.  We don't have enough people in the city to man all the departments to make it happen the way its set up.  Schuett-we're waiting on the zoning board.  Gerwin-zoning committee is not that far off.  We've had an almost total turnover in the zoning board and we're trying to get the new people up to speed.  Back to Brown:  Mid-Ohio Lime-you were going to get back to them.  Gerwin-we're draining the swamp and it's a matter of writing legal descriptions.  I haven't had time.  Brown-we want to get access to that land.  Gerwin-I don't think that's going to be a problem.  I'd like to see where that quarry level sets.  The water is higher than I would have ever guessed.  Since we've got drainage tile and hopefully have stabilized the water level.  The next step is to write a legal description that gives the new boundaries around that property line.  Beck-we'll need to survey.  Gerwin-yes, and that would come out of general fund.  Beck-that was surveyed a few years ago, existing at that time.  That would be an expensive process.  It's hard to survey around that quarry and some of the prior pins are underwater.  Gerwin-I think we need to wait till finances are in better condition.  Peg's comp time-Gerwin-dropped it.  Webpage poster to advertise.   Wondering about minutes.  Only received one set.  Ruggiero-lost village e-mail in state cutbacks.  Could send from home.
Johnson-Jerry and I attended the Economic Development session Tuesday morning.  It was a good session.  Well attended.  I think once we have an industrial site

ready, I think we'll get the attention we need to do something.  Jerry-part of the hand-outs they had of the proposed building that everyone used, the different revenue the taxes would generate from that through the different communities.  We were not the highest, but far from the lowest.  Gerwin-as a side note.  One thing the Economic Development Corporation has done on their website.  They show pictures of all the industrial sites in all the area communities and ours is up there.  Its mostly field and isn't a lot, but its up there.  Brown-it should be a link to our website.  Gerwin-yes.  Quarry drain-water is 6 inches above the pipe and its barely coming out the other end.  Gerwin-I'm out there once a week and the guys are often.
          Herman-Zoning meeting only 2 showed up.  Port-a-potties-employee reported them looking bad after Homecoming.  Gerwin-they came in daily, I believe, during the Homecoming.  Unsure of Sunday after.  Brown-I called asking about daily records.  They never called me back.  Herman-they said you never identified yourself.  Brown-I gave name and number.

Minutes of May 20, 2004 Meeting of Regular Session

Lois Larson called the meeting to order at 7:30pm.

Roll Call:  Oller-here, Schuett-here, Brown-here, Johnson-here, Herman-here, Kirwen-absent.
Motion to excuse Kirwen by Oller.  Schuett-2nd.  Unanimous roll.

Others in attendance:  Merv Hall, Jim Krotzer, Cathi Smith, Deb Johnson, Dan Henery, Eric Arquette, (Fire Chief Ed Bauer arrived late)

Changes to previous minutes noted by Schuett-under old business "Kirwen mentioned the sale of property should be at $12,000 minimum".  Changes noted by Brown-should read "online-not at police dept" and should be written that "the park meeting is a publicly posted meeting and shouldn't be cancelled for one person".

Mayor noted that meetings should go back to original agenda.  Anyone at a meeting who wants to speak, but is not on the agenda, should fill out a sheet and can speak at the end of the meeting.  Everyone will have 5 minutes of uninterrupted time to speak.  Comments to be made after.

Recognition of Visitors:
          1) Dan Henery on health insurance issues.  Work session scheduled May 27 at 7:30 with council.  Additional information will be presented.  Plan on staying with same insurance company.
          2)  Merv Hall on noise problem.  Same problems plus all doors and windows now open.  Gerwin-an extension was put on the stacks and had heard from Deb that it didn't help any.  Hall-buzzer, phone, and employees make noise in early hours.  Gerwin-will continue to work on this.
          3) Joe Darr-not present but Gerwin speaking on his behalf.  Darr looking at making a residential development along his quarry (4 residential lots).  Knowing he'll have to put in sewer and water, he's wondering if village is willing to split cost of bigger sewer line in case any development would occur beyond his property.  No immediate answer needed.  Brown-if he would need 4-inch line but eventually we develop beyond and may need a 6-inch line.Gerwin-or 8-inch and we pick up part of the cost.  Brown-do we design or Poggemeyer?  Gerwin-engineers would be needed.  Brown-at whose cost?  Gerwin-we would probably split the cost.  He could go alone to do his piece and then we could do ours for future expansion.  Brown-would that be a good idea?  Gerwin-we should think about it for future discussion.
          4) Teresa Aldrich-cat problem.  Not present.

Old Business:          
          1) Ordinance 10-2004.  Beck-its been re-worded.  Need motion to take off table for a 3rd reading.  Johnson-wait for a full council.  Does it need to pass by 4/5s?  Beck-majority needed to pass.  Johnson-since its related to taxes, it doesn't need more?  Beck-no.  Mayor-we'll leave tabled for now.
          2) 3rd reading of Ordinance 13-2004 AN ORDINANCE REGULATING THE INSTALLATION OF ELECTRICAL SERVICE FOR THE INDUSTRIAL PARK LOCATED ON

New Business:
          1) 1st reading of Ordinance 15-2004 AN ORDINANCE TO INCREASE THE SEWER TAP FEE FOR NEW CONSTRUCTION.
          2) 1st reading of Ordinance 16-2004 AN ORDINANCE AUTHORIZING PAY INCREASES TO CERTAIN EMPLOYEES, WAGES, AND SALARIES.

Mayor's Report:
          Need to go into executive session at end of meeting to discuss the status of several funds due to audit information.  The audit is not complete and cannot be made public at this time.                                                                                          

Administrator's Report:
1) Last year we thought we had transferred 10.75 acres from the industrial park to the well fields.  The money should have been transferred from the water account into the general fund to reimburse it for that.  It did not happen.  The auditors indicated that we need a motion on the books this year to authorize it to happen this year.  Oller-motion to make the transfer.  Schuett-2nd.  Mayor-comment? None. Unanimous roll call.
2) Problems with Stevenson Street storm water drainage.  Kevin believes it may be a collapse.  It's a continuing problem.  Should we look at replacing the 6-inch or putting in an 8-inch line? Brown-I was down there the other day and it was horrible.  Johnson-do we know for sure what the problem is?  Gerwin-if there is a small enough camera, we could camera that first.  It would cost a few hundred dollars.  Schuett-could you get a cost on it?  Gerwin-I can do that.  Johnson-is that something we can do ourselves or do we contract it out.  Gerwin-we can look at it but want to make sure its done right.  You have to look at the fall, etc.
3) Signs have been ordered for each facility for the new concealed weapons law.  Temporary ones are currently up.  We are not allowed to keep people who have a right to carry concealed weapons from carrying them in the parks.  I didn't realize it and was about to order them for the parks when Mike said "you can order them but don't put them up yet".  Evidently the City of Toledo is putting them up and are going to fight it legally and have asked for help from other communities.  Mayor-I think Clyde is doing the same thing.  Gerwin-I did order the signs, but I won't put them up in the parks yet.            

Clerk-Treasurer's Report:
          1) After negotiating with 5/3, they have decided to waive the service charges through the end of the depository agreement (August 2005). 

Standing Committee Reports:
          Finance Committee-Chairman Schuett.  Pay increases have been brought up.  Nothing further at this time.
          Laws, Rules, & Ordinances Committee-Chairman Johnson.  Nothing.
          Capital Improvements-Chairman Herman.  Nothing.
Individual Council Member Reports:
          Oller-nothing.

          Brown-Website-should it be put in the newspaper telling people its under construction, that we need information to keep moving?  Mayor-I think we should hold off on the website because of finances.  Johnson-its not very much money.  Mayor-over time.  Johnson-we already approved doing it.  Mayor-someplace you're going to have to stop spending.  I don't feel that's something that's necessary.  Brown-we did decide on it.  It's going to be $300 for her to do it, we've already pursued it.  Her time isn't that much money-$10.00/hr, 2-3 hours a month at the most and it's a community service project.  Mayor-with money the way it is you can't just do everything you would like to do.  Since its been approved, go ahead.  Gerwin-can we put that in Paula's column.  Brown-if its e-mailed to her to put on the website, it's a matter of cutting and pasting, which won't be very much at all.
Park Committee meeting on June 8, could we ask the members to meet at 7:00 and put it on the post card to meet at William's Park by the waterfalls.  Talk and work.  Mayor-it depends on them.  Brown-that's what I'm asking, can I ask the members to do that?  Ruggiero-they've met at the parks in the past.  Mayor-as long as they're agreeable to it.  Can the pumps be put in and have ready to turn on by Memorial Day?  Gerwin-OK  BCP Grant-the kids did not get.  They felt the kids were just asking for the funds and weren't participating in the work since kids can't put up fences.  They didn't feel that was a project they'd want to support.  Pole heights-is anything being done?  Gerwin-evidently during the winter as things froze and thawed it caused the movement.  It will have to be redone.  Similar to the hump in the one-way street, a rock or something pushing up through.  Dandelions have been killed and it looks good.  Complaint about ball diamonds not being done last night, yet girl's softball diamond was done really well.  Gerwin-the gentleman that does it was injured and went to hospital for stitches.  Brown-do we look at hiring someone to do it or let other volunteers use the equipment?  What happens when something happens to Bob?  Mayor-we'll study that.  Circus property?   Gerwin-haven't heard back about it.  Brown-they need an answer tonight to get tickets printed.  Gerwin-regardless of whether we get that front piece or not, the location is the same.  Brown-several people measured down at William's and it is tight.  Gerwin-I'm concerned they'll get here and say its not going to fit.  Brown-2 sites should be available.  If one doesn't work they can go to the other one.  That's the way the contract is written up.  Gerwin-how do we tell them which location goes on the tickets?  Brown-could the volleyball area be moved to Central Park?  Gerwin-they could be moved.  Brown-it'd be nice to do them like Joe Walby's.  Gerwin-I had asked about a sand court 2-3 years ago and they didn't want a sand court.  Brown-can I contact them about moving the court.  They'd really like to have the circus at William's.  If not that option then they'll go out to Eagle Lake.  Gerwin-that might work better yet, but go out there to see if you can get a post in.  Brown-they need a answer.  Taps on Linden done?  Gerwin-No, I know where he's working and I'll find out.  Linden Avenue crossing?  Gerwin-we're waiting for the concrete tile to come in.
          Johnson-Even though Teresa Aldrich is not here, we do have cat problem.  Mayor-we don't have a cat ordinance and can't really enforce it anyway other than trap them.

Fire Chief Bauer-Attended Madison Township meeting on Monday night and discussed in detail methods to resolve fire dept purchasing issues.  Was hoping John Fork would be here tonight to report.  Comment on ball diamond issue-people have been whining about stuff not being done.  Gibsonburg has 6 ball diamonds.  It's rained about every day this week.  Yesterday, five of the six diamonds were prepared for ball.  For someone to say 1 diamond didn't get done, we need to look for additional help.if you don't want Bob to do it, get somebody else.  Someone needs to get some courage, say we're running the show, and this is how it is: if it rains and you can't play, you can't play.  Bob did get injured yesterday.  That other field wouldn't have been done anyway because it was under water.  Gerwin-Bob does a good job.  Mayor-he does.  Brown-he has more diamonds than he's ever had.  Bauer-he's not complaining, you are.  How can you dry diamonds?  He did 5 out of 6.
